Can I Relocate An Easement On My Property?

Because easement agreements can last for decades, it’s not uncommon for a property owner to wish to adjust or relocate the easement at some point in time. Perhaps they want to use part of the land where the easement runs in a different way, or they simply think providing access in a different manner would be better for everyone. Although the easement is located on your property, do you have the right to relocate or adjust it as you please? How To Move An Easement

You may assume because you own the property and the easement is located on your property that you have free reign to do as you please when it comes to relocating the easement. You should be able to switch the easement to a different access road or move the location of a parking lot if you please, right? Unfortunately, it’s not just your call. 

An easement is an agreement between two parties, so even though you are the land owner and you’re allowing other parties to have access to your land, the existence of the easement means it is no longer only your call as to what happens with that portion of your property. In order to relocate the easement, you’ll need to get permission from the benefitted party. Absent permission from the benefitted party, you could be found in violation of the easement agreement for attempting to adjust it. 

Even if you get permission from the other party or they are on board about relocating the easement, you’ll still have some steps you’ll want to take to ensure everything is legally sound.
