Can You Purchase An Owner’s Title Insurance Policy At Any Point In Time?

Can you secure an owner’s title insurance policy at any time, or does it need to take place as you close on the property? We take a closer look at your options for securing an owner’s title insurance policy in today’s blog.

An owner’s title insurance policy protects you against title issues that are discovered during your tenure as the property owner.

The vast majority of people secure this policy at closing or right after they close, but it may be possible to secure it months or years later if needed. We understand that money can get tight and you may want to cut costs where possible, and you can certainly purchase an owner’s title insurance policy later in life, but it’s typically not a wise move to wait.

For starters, you’ll usually get a better rate if you do it at closing. Not only have title investigations already happened during the due diligence stage of the transaction, but your policy cost is based on the purchase price of the property. If you wait years to secure a policy, not only will you likely have to pay for another title search, as the insurance company will want proof that there are no issues with the property’s title, but there’s a good chance that property values will have naturally risen or increased because of the improvements you’ve made to the commercial space or the success you’ve had with your business.

There’s also the real possibility of an issue being discovered during the period you forgo title insurance. You may plan on grabbing it six months down the road, but in our experience, the months after closing are often the most common period when undiscovered title issues come to light. Heirs learn that a property they thought was theirs has been sold, a neighbor digs deeper into boundary rights as a new person moves in, or a judgment lien is discovered now that a business learns that a debtor is moving off the property. The months that follow a sale are when most undiscovered title issues come to light because there are more eyes on the property than in years past, and if you don’t have an owner’s title insurance policy, these old issues can become your problem to address.

So yes, you can typically secure an owner’s title insurance policy down the road, but it’s risky and usually more costly to do so.
