The Differences Between Residential And Commercial Closings

Whether you’re buying a home or you’re securing commercial property to launch your next business, you’ll acquire the property after going through the closing process. Closing day effectively wraps up the transaction and ends with you officially becoming the new owner of the property. And while residential and commercial closings are similar in that manner, they differ in a number of ways, and it pays to be aware of these differences so you can protect your interests and keep the transaction on track. In today’s blog, we explore some of the differences between residential and commercial closings.

Both a residential and commercial closing will include title investigation, ownership confirmation and signing some documents at closing, there are some stark differences between the two processes as well. The main difference between commercial and residential closings is the complexity of a commercial closing. That’s not to say that a residential closing isn’t an involved process, but you’ll need to check a number of additional boxes if you’re hoping to close on property that will likely be used as a revenue-generating asset.

With a residential closing, you’ll probably look into a few aspects of the sale after your offer is accepted but before you officially close. Most residential buyers use this time to order inspections, investigate the title and ensure their financing is in order. Commercial property purchasers typically need to conduct additional inspections and assessments during the due diligence stage of the transaction, including:

  • Boundary surveys

  • Environmental surveys

  • Land use rights

  • Zoning regulations

  • Easements and shared access rights

  • Covenants and development restrictions

  • Existing lease or tenant agreements

  • Income/Expense reports

  • More involved title investigations

  • Title issues

  • Liens/Unpaid Fees

Also, because most commercial property purchases are larger than a single-family residential property, there’s also a good chance that you will be more involved on the financing side, either ensuring that you are approved for a large loan or working with investors to ensure you have the necessary funds at closing.

We point all this out to help hammer home the point that the single best thing you can do if you’re moving forward with a commercial acquisition is to connect with a commercial title services team. You want a company that specializes in commercial real estate and commercial title services because there are so many additional steps that need to be taken to ensure everything is done properly before you take over as owner. This is likely one of if not the most expensive purchase you’ll make in your life, don’t put your financial future at risk because you didn’t connect with an industry professional in the commercial title services world.
